Dear Mr. Dancer:
The Executive Council, at a meeting held this date, approved the following
Right-of-Way and Easement for Sanitary Sewer Pumping Station:
The Iowa. State Board of Education for and in consideration of the
conditions as herein contained, does hereby grant to the City of
Ames, Iowa, the right to construct, reconstruct, operate, maintain
and repair a sanitary sewer pumping station in the location as
described herein and shown on the plat attached hereto and made a
part hereof, upon and across the property of the State of Iowa known as
Iowa State College, located in Lot six (6) of the West one-half of the
North-west one-quarter (Vgl�) of Section 4, Township 83 Forth, Range
24 West of the 5th P.M. so long as the said City operates and
maintains said station after its installation.
The foregoing right is granted upon the following express conditions, to-wit:
(1) That, the pumping station shall be constructed within the
following described location:
Beginning at the point of intersection of
the East and West quarter line of Section
4-83-24 with the East line of Hyland Avenue
in the City of Ames, Iowa; thence East
25 feet; thence North 50 feet; thence West
25 feet; thence South 50 feet to the point
of beginning.
(2) That, the City of Ames, Iowa, will assume liability for all
damage to the property of the State of Iowa known as Iowa State College,
caused by said City's failure to use due care in its exercise of the
granted right.
(3) This easement is not assignable.
