Al That Jerry D. Gardner and B. Colleen Gardner , Husband and
Wife, in consideration of the sum of one dollar, receipt of which is hereby
XAV acknowledged, do hereby grant to the City of Panes, Iowa; a Municipal Corporation,
its successors and assigns , the perpetual right to construct, reconstruct,
repair, maintain and use its overhead and underground electric lines, poles,
anchors, wires, cables and other similar equipment or any part thereof together
with a right to trim trees for safe operation of overhead electric lines for
the sole purpose of conveying electric current for power and lighting purposes
overhead or underground of the real estate described as follows:
The South 4 feet of Lot 10 Overland Heights Subdivision,
Ames, Story County, Iowa.
The foregoing rights are granted upon the express condition that the City
of Ames will assume liability for all damage to the hereinbefore described pro-
perty caused by said City's failure to use due care in its exercise of the
granted rights.
