Hanson Lumber Co . , Inc . , in consideration of One Dollar, the receipt of which is hereby acknowledged, grants to the City of Ames , Iowa, a Municipal Corporation, its suc- cessors and assigns , the perpetual right to construct , re- construct , repair , maintain, and use its overhead and under- ground electric lines consisting of poles , wires , cables , anchors , and other similar equipment or any part thereof, for the purpose of conveying electric current for power and lighting purposes , together with the right to extent to any telephone company, the right to use jointly with the grantee, any pole or other equipment placed pursuant to the provisions hereof, and together with the right to trim or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the fol- lowing described real estate : See Exhibit A and Exhibit B attached describing areas A, B , C, D and E on a plat of S . Hanson Lumber Company property, East of Borne Avenue and South at the C & NW Railroad in Ames , Iowa. It is further agreed by the undersigned that no new trees shall be planted or maintained on said right-of-way, however, the right is reserved by the grantor and its successors in interest , to construct , reconstruct , repair and improve a building or buildings or other structures on said easement areas and under said utility lines . The foregoing rights are granted upon the express condi- tion that the City of Ames will assume all damage to the hereinbefore described property caused by the City' s failure E to use due care in its exercise of the rights granted during construction, maintenance and r it of said premises .
