HORH9ACHER, Recorder RIGHT OF WAY PERMIT AND EASEMENT �r ••••• -• •� •n•••D'P�`1' I, Ruth Elding, a single person, of Story County, Iowa, for myself, successors and assigns, in consideration of the sum of One Dollar and other good and valuable consideration, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a Municipal Corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain, repair and use its electric lines, consisting of poles, wires, overhead cables, underground cables, fixtures, anchors and other similar equipment, or any part thereof for the sole purpose of constructing a 69,000 volt power line and other electric lines for conveying electric current for power and lighting purposes, together with the right to extend to any telephone, electric or power company the right to use jointly with the grantee any pole placed pursuant to the provisions hereof, and together with the right to trim any trees or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the following described real estate: The North 35 feet of the Northwest One Quarter of the Northwest One Quarter of Section 14, Township 83, North, Range 24 West of the 5th PM, Story County, Iowa. together with the right to trim trees for a distance not to exceed 20' outside the above described right of way for construction purposes. It is further agreed by the undersigned that no new trees shall be planted or maintained on said right of way, and that no buildings or other structures shall be built under the said utility lines nor with the distances prohibited by the National Electric Safety Code (National Bureau of Standards Handbook No. 81) or latest revisions thereof. It is recognized that this right of way is applicable lyelec ric ervice to ddiacen prop rties and alignment is planned approximately sou�h o the norIi sec on eline. The foregoing rights are granted upon the express condition that the City of Ames will assume all damage to the hereinbefore described property caused by the City's failure to use due care in its exercise of the right granted; and, that the City will pay for all crop damage during construction, maintenance and repair on said premises.
