L County, State ali ornia, parties of the first part,
and e Uity of Ames, of Story County, and State of Iowa, party of
the second part, WITNESSETH:
' That the said parties of the first part, for and in consider-
ation of the benefits to be derived from the construction and main-
tenance of a storm sewer over or adjacent to the property herein-
after described, have bargained, sold and conveyed unto the said
party of the second part or its assigns the r l&ht to enter upon,
csonstruat �, reconstruet, perpetuate , keep repair,and maintain a
atomsewer 'acm s' or adjaee.nt to ' the �o��v�ring described real es-
tate situated in the City of j Ames, Story (bounty, Iowa, to-wit:The North 30 feet of the. west 231 1 feet of Lot 2, and the South
20 feet of the Vest 231,1 feet of Lot 1, Block 4, Beardshear's Ad-
dition to the City of: Ames, Iowa , except the West 50 feet, and for
that purpose convey unto the said party of the second part an ease-
ment forever over the following described premises situated in the
M City of Ames* Story County, Iowa, to-wit, -
The North. 30 feet of the Vest 331..1 feet of Lot 20 and
the :3cuth ZO feet of the West 233:.1 feet of Lot 1, Block
4, Beardshearts Addition to the City of Ames, Iowa , ex-
cept the West 154 feet ,
and far and n f rthe : considera ti as of the premises, wet R. H. Me-
Gar thy and, McCarthy, our heirs and assigns , hereby
waive any an all cams for any damages which might or may be
caused by the eons true ti on, re cons true ti m , per pe tua ti on, repair ,
maintenance or overflew of said storm sewer, and waive any and
all claims for damages now or hereafter sustained from any flood
water caused by the inability of said: storm 'ewer to receive and
carry the same .
�f We further agree that we will make no connection with said
{I storm sewer, except under the permission of the City Manager of
the City of Ames, Iowa, and in accordance with such. rules and regu
lations as he may prescribe.
.and we hereby covenant with the said City of Ames, Iowa , that
we hold said premises by good and perfect title and that we have
good right, and lawful authority to sell and convey the same ,
