Kay Buckley and Mildred McLaughlyn in consideration of the sum of One Dollar and other good and valuable consideration, the receipt of which is hereby acknowledged, (do/)dJBA,6) hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to enter upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, and cover over and repair a sanitary sewer upon, under and across the land descrrii ed as follows: DESCRIPTION: A permanent easement 10 feet on both sides of and a temporary easement up to 50 feet on both sides of a line more particularly described as follows: Commencing at the southeast corner of Lot 3 in the South 1/2 of the NW 1/4 of Section 26-T84N-R24W and running westerly along the south property line of said Lot 3 a distance of 72.1 feet to the point of beginning, thence N 30033135" W 121 feet to the north property line of the south 100 feet of said Lot 3. See attached plat marked Exhibit A and made a part hereof. There is also hereby granted a right of ingress and egress over and across adjacent land and a temporary right of encroachment over and across adjacent land on either side of the above described line only during the period of construction. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted. Kay Buckley and Mildred McLaughlyn for the granting of the right of way permit and easement in connection with the Skunk River Sanitary Outfall Extension and made a part thereof. a. The Cityof Ames will 3OO OO pay a total of $ b. The City of Ames will seed the area with a bluegrass seed mixture containing at least 70% bluegrass. C. The City of Ames will repair the building located in the area if it is damaged. d. At Station 80+00 - 79 feet left there is a 14-inch diameter tree. At Station 80+75 8° feet right there is a 10-inch diameter tree. The City of Ames will attempt to save these trees; but if it is necessary to remove these trees, the City of Ames will pay 50.CEO $ for each tree removed. The City will cause the trees to be placed adjacent _, to the right of way for the property owners ' benefit. c
