in consideration of the sum of One Dollar and other good an valuable
consideration, the receipt of which is hereby acknowledged, (dold)6AA)
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns, the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a sanit_a_rX __�
sewer upon, under and across the land described
as follows:
DESCRIPTION: A permanent easement 10 feet on both sides of and
a temporary easement up to 50 feet on both sides of a line more particularly
described as follows: Commencing at the southeast corner of Lot 38, Over-
land Heights Subdivision, and running westerly along the south property
line of said Lot 38 a distance of 55.2 feet, thence N 7°39 ' 15" W 160 feet
to the point of beginning, said point being on the south property line of
Lot 41, Overland Heights Subdivision; thence continuing N 7°39 ' 15" W 3.0
feet, thence N 2005145" E 81.5 feet to the north property line of said
Lot 41.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted. 11

SUPPLEMENTAL LETTER OF AGREEMENT
October 18, 1973
This supplemental letter of agreement outlines additional
consideration given to Harold A. and Elsie L. Swanson for the
granting of the right of way permit and easement in connection
with the Skunk River Sanitary Outfall Extension and made a
part thereof.
a. The City of Ames will pay a total of $960 .00 .
b. The City of Ames will replace the topsoil in the
top of the sewer ditch - Lot 41 and Outlot "A" .
c. The City of Ames will seed and fertilize the top of
the sewer ditch - Lot 41 and Outlot "A" .
d. The City of Ames agrees to cut the trees necessary
for construction in the southerly of the three areas
(east of the Campfire Girls Camp) into 10 foot lengths
and stack them -tee tie—Farr pool area. lwDIarAe 14.
e. The City of Ames will protect both the river bank and
the barn which lies close to the project.
f. The City of Ames will provide o free sew connection
to the sewer.
