That Y//we) , Harold A. Swanson and Elsie L. Swanson, husband and wife,
in consideration of the sum of One Dollar and other good and valuable
consideration, the receipt of which is hereby acknowledged, (do/")
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns , the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a sanitary
sewer upon, under and across the land described
as follows:
DESCRIPTION : A permanent easement 10 feet on both sides of
and a temporary easement up to 50 feet on both sides of a line more
particularly described as follows: Commencing at the northeast corner
of Outlot A, Scalado Ridge Third Subdivision, and running westerly along
the north property line of said Outlot A a distance of 27 .2 feet to the
point of beginning, thence S 2°05 '45" W 329 feet to the south property
line of said Outlot A.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted. `�
