That (Ylwe) , North Grand Care Center , Inc. ,
in consideration of the sum of One Dollar and other good and valuable
consideration, the receipt of which is hereby acknowledged, (do/qTgrVg9
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns , the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a sanitary
sewer upon, under and across the land described
as follows:
DESCRIPTION : A temporary construction easement 100 ft. in width and
a permanent easement 20 ft. in width over and across the S. 8 acres of the S.
10 acres of the N. 1/2 of the T,7A1 1/4 of the SW 1/4 of Sec. 26-T84N-R24W cen-
tered on a line more particularly described as follows: Beginninq at a point
27.2 ft. W. of. the SE Cor. of said S. 8 acres and running thence N. 46*11135"
W. 380 ft. + to the N. line of said. S. 8 acres.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted.
