of and a temporary easement up to 50 feet on both sides of a

southeast corner of Lot 36 , Overland Heights Subdivision, and
running southwesterly along the 'southeast property line. of said f
Lot 3f a distance of 30` feet to the point of beginning,.. thence
N 21044130" W '117. 5 feet to a point on the north property line
of said Lot 36, said point..bei;ng 40 feet westerly from northeast
corner of said Lot 36.
See attached plat marked Exhibit A and made a..part
hereof.
There is also hereby granted a right of ingres.4 and
egress over and across adjacent land and a temporary right .of
encroachment over and across adjacent land on either side.`of <the
above described line only during the period of construction. '
The foregoing rights are granted upon the express
condition that the City of Ames, Iowa, dill assume all liability: .;
for all damages to the above described property caused by the
City's failure to use due care in ,its exercise of the rigtttfs

SUPPLEMENTAL LETTER OF AGREEMENT
December 10, 1973
This Supplemental letter of agreement states additional.',
consideration given to David W. Gregory and Marjorie A. "Gregory,
husband and wife for the granting of the right-of-way permit and _"-
easement in connection with the Skunk River Sanitary Outf;all
Zxtens.;Lorx and made a part hereof.:'
-a) The City of Ames will pay the total of $1,354.62.
b) The City, of Ames will seed and fertilize the top
of the''aewer ditch.
-c) The City of Ames further agrees that in the event,
during 'construction, any trees or shrubs are
damaged in the course of construion, outside
the permanent easement on `the`property of the
above named,_ the 'City of Ames .;will pay the ,.,above
named reasonable damages
