That we, Archie-Wier-son and Letha Wiersoft hasb'and 'and

acknowledged, do hereby grant unto the City of Ames, Iowa, a
municipal corporation, its successors and assigns, the perpetual
right to enter upon the land described and the perpetual right

cover over and 'repair a 'sanitary `sewer upon, under and across the
land described as follows:
DESCRIPTION A strip of land twenty (20) feet wide,
'being ten (10) feet on each side of a line described as follows:
Commencing at the Northeast corner of Lot 13, Northwood Estates ''
3rd Addition, and running easterly along the south property Tine
of Lot 35, Overland Heights-Subdivision, a distance of 14.1
feet to the point of beginning, thence N 36033125" W. 31.5 feet
thence 59046145/1 W. 353.6 feet, thence N' 21044"30" W. 62 feet to a
point on the-northwest property line of said Lot 351 said point
being `30 feet southwesterly from the southeast corner of Lot 36,
Overland Heights Subdivision.
See attached plat marked Exhibit A and made a part:
hereof.
There is also hereby granted a right of ingress and
egress over and "across adjacent land and' a temporary right of
encroachment over and across adjacent land ;on either side of.', the
above described line only during the period of construction.
The foregoing rights are granted upon the express
condition that the City of Ames, Iowa, will assume all liability
for all damages to the above described property caused by the
City's failure to-use. due care in its exercise of the rights
granted.

and wife for the granting of the right-of-way permit and .easAment
in connection with the Skitnk River Sanitary Outfall Ekteosi§p and'" ' ;
made a part hereof:
a) The City of Ames will pay the total of` $1,765` 00.
b) The City of Ames- will seed and fertilize the top
of the sewer ditch,
c) The City of Ames further agrees .that, in the..,event'.,
during construction, any trees or shrubs are,
damaged in the course of construction, outside. the
permanent' "eas-ement on the property of the above
named:, the City of Ames will, pay the above.; named
reasonable damages.
