Henri Husband and Wife, in consideration of the sum of one dollar, receipt of which is hereby 'acknowledged, do hereby grant to the City of Ames, Iowa, a Municipal Corporation, Q its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain and use its underground electric lines , wires , cables , ground mounted transformers and other similar equipment or any part thereof for the sole purpose of conveying electric current for power and lighting purposes underground of the real estate described as follows: The south 5 feet of the north 140 feet of the east 85 feet; and the east 5 feet of the south 80 feet of the north 135 feet of lot 2 W.H. The foregoing rights are granted upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said City's failure to use due care in its exercise of the granted rights.
