We, E. J. Litzel and Margaret E. Litzel, husband and
wife, and Harry M. Anderson and Margaret H. Anderson, husband and
wife, in consideration of the sum of One Dollar, receipt of which
is hereby acknowledged, do hereby grant• to the City of Ames, Iowa,
a municipal corporation, its successors and assigns , the right
to construct, reconstruct, maintain and use its underground
electric lines across the following described real estate:
The South five feet of the East fifty five feet of the West
one hundred fifty feet- of Sub lot eight in lot thirteen, in
the West one-half of the Southwest one-quarter of Section Four,
in Township eighty three North, Range twenty four West of the
fifth PM in Ames, Iowa.
for the sole purpose of conveying electric current for power and
lighting purposes.
If at any time the grantors, their heirs or assigns,
determine that this easement interferes with the development of the
real estate or adjoining real estate, then this easement right
shall terminate upon the lapse of a period of six months from and
after written notice has been given to the City Clerk of the City
of Ames , Iowa, requesting the City to discontinue the use of its
easement right.
This easement right is granted upon the express conditio
that the users of the granted right will assume liability for all
damage to the hereinbefore described real estate and adjoining
real estate caused by failure to use due care in the exercise of
the granted right.
