RIGHT-OF-WAY PERMIT AND EASEMENT
KNOW ALL MEN BY THESE PRESENTS :
That we, Tom A. Brindley, and LaVerna R. Brindley,
husband and wife, of Ames, Story County, Iowa, in consideration
of the sum of One Dollar, receipt of which is hereby acknowledged
do hereby grant to the City of Ames, Iowa, a municipal corpora-
tion, its successors and assigns, the perpetual right to construc ,
reconstruct, maintain and use its electric lines, consisting of
poles, wires, overhead or underground cables,. fixtures, anchors,
and other similar equipment, or any part thereof, upon, under-
ground, over, or across the following described real estate:
-The West 7 2 feet of Lot One (1) ;
The North 72 feet of Lots One (1) , Two (2) ,
and Three (3) ;
The East 72 feet of Lot Three (3) ;
The South 72 feet of Lot One (1) ;
all within Brindley' s Subdivision of Ames, Iowa, for the sole
purpose of conveying electric current for power and lighting
purposes, together with the right to trim any trees and to allow
for clearance of at least 4 feet, where necessary, for the safe
operation and use of overhead electric lines. We do further
grant to the City of Ames, Iowa, the right to permit other
utility companies to construct, and in the same manner, maintain
its utility facilities, jointly or severally, upon, underground,
over or across the real estate as described above.
The foregoing right is granted upon the express condi-
tion that the City of Ames, Iowa, or other utility exercising
said rights, will assume full liability for all damage to the
hereinbefore described real estate caused by the City' s failure
or the failure of other utility exercising said right, to use
due care in its or their exercise of the granted right.
