Friedrich and Sons Inc, an Iowa corporation in consideration of One Dollar, the receipt of which is hereby acknowledged, grants to the City of Ames, Iowa, a Municipal Corporation, itssuccessors and assigns, the perpetual right to construct, reconstruct, repair, maintain, and use its overhead and underground electric lines consisting of poles, wires, cables, anchors, and other similar equipment or any part thereof, for the purpose of conveying electric current for power and lighting purposes, together with the right to extend to any telephone company, the right to use jointly with the grantee, any pole or other equipment placed pursuant to the provisions hereof, and together with the right to trim or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the following described real estate: The East 5 feet of the West 65 feet of Lots 9 and 10; the South 5 feet of the West 60 feet of Lot 9; the East 5 feet of the South 21 feet, the South 5 feet of the West 55 feet of the East 60 feet, 6� and the West 5 feet of the East 65 feet of Lot 12; all in Hunziker- 11,40 Furman Fifth Addition to Ames, Story County, Iowa It is further agreed by the undersigned that no new trees shall be planted or maintained on said right-of-way, and that no buildings or other structures shall be built under the said utility lines nor within the distances prohibited by the National Electric Safety Code (National Bureau of Standards Handbook No. 81) or latest revisions thereof. The foregoing rights are granted upon the express condition that the City of Ames will assume all damage to the hereinbefore described property caused by the City's failure to use due care in its exercise of the rights granted during construction, maintenance and repair on said premises.
