Mille'r, husband and wife, in consideration of One Dollar, the receipt of which is hereby acknowledged, grant to the City of Ames, Iowa, a Municipal Corporation, its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain, and use its overhead and underground electrical lines consisting of poles, wires, cables, anchors, and other similar equipment or any part thereof, for the purpose of conveying electric current for power and lighting purposes, together with the right to extend to any telephone company, the right to use jointly with the grantee, any pole or other equipment placed pursuant to the provisions hereof, and together with the right to trim or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the following described real estate: The North 6 feet of the East 50. 35 feet of Lot 20 of the North Part of Brown's Subdivision, Ames, Story County, Iowa. The foregoing rights are granted upon the express condition that the City of Ames will assume all damage to the hereinbefore described property caused by the City's failure to use due care in its exercise of the rights granted during construction, maintenance and repair on said premises.
