RIGHT-OF-WAY PERMIT AND EASEMENT

'Die Nash-Finch Company, a corporation formed under the laves of
in consideration of One Dollar ( 1.00), receipt of which is hereby acknowledged,
hereby grants to the City of A.nnes, Iowa, a municipal corporation, its successors and
assigns, the perpetual right to construct, reconstruct, repair, maintain and use its
electrical lines, .poles, anchors and other similar equipment or any pert thereof for
the sole purpose of conveying electrical current for power and lighting purposes
underground and overhead of the real estate described as follows:
A parcel of land commending 244 feet South of the Northeast Corner of
the Northwest 1/4 of Section 14 along the East line of said quarter, thence
West 615 feet to a point South 001' West 247 feet from the North line of
said quarter, thence North 001' East 9 feet, thence East 615 feet to a
point on the .East lime and 235 feet South of the Northeast corner of said
quarter, thence South 9 feet to the point of beginning but excluding highway
right-of-way.
The print attached shows the parcel as a shaded section and is a part hereof.
No trues shall are planted in the easement and the City of Ames shall not be
liable, for ornamental shrubbery in the easement in the event of underground distribution
construction or repairs. Rights to trim trees adjacent to this easement for safe
operation of overhead :lines shall be granted.
Structures built on the property shall provide electrical clearances meeting the
requirements of the National Bureau of Standards Handbook. No. 81, or latest revision
thereof, for safety. No new structures shall be built under the lanes nor within limits
prohibited by said Handbook No. 81.
These rights are granted upon the express condition that the City of Ames shall
assume liability for all damages to the hereinbefore described real estate caused by
the City's failure to use due care in the exercise of its rights.
