Inst . �f 706� Fee S Le50 ELECTRIC UTILITY EASEMENT The Ames Community School District of Ames, Iowa, in consideration of One Dollar ($1. 00), the receipt of which is hereby acknowledged, grants to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain, and use its overhead and under- ground electrical lines consisting of poles, wires, cables, anchors and other similar equipment or any part thereof upon or across the following described real estate: A parcel of land consisting of the hest 5 feet of Lot 4 of Miller Is Subdivision of Lot 1 of Block 44, Third Addition, Ames, Iowa. It is further agreed by the undersigned that no structures or buildings shall be built jmder or upon said utility lines in the easement area. The foregoing rights are granted upon the express condition that the City of Armes will assume all damage to the hereinbef ore described property caused by the City's failure to use due care in its exercise of the .rights granted during constructio , maintenance, and repair on said premises.
