RIGHT OF WAY PERMIT AND EASEMENT
Ethel Bennett, a single person, and Emil O. Boetger and Florence Boetger,
husband and wife, in consideration of one dollar, the receipt of which is hereby
acknowledged, grants to the City of Ames, Iowa, a Municipal Corporation, its
successors and assigns, the perpetual right to construct, reconstruct, repair,
maintain, and use its electrical lines, wires, cables, anchors and other similar
equipment or any part thereof for the purpose of conveying electric current for
power and lighting purposes overhead or underground on the following described
real estate:
The East 7 feet of the West 101 feet of Lot 13, Block 7,
Duffs Addition to the City of Ames, Story County, Iowa.
These rights are granted upon the express condition that the City of Ames
shall assume liability for all damages to the hereinbefore described real estate
caused by the City's failure to use due care in the exercise of its said rights.
