consideration, the receipt of which is hereby acknowledged, (do/does)
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns, the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct, M
clean up, operate, maintain, and cover over and repair a F
sanitary sewer upon, under and across the land described yler'
as follows:
DESCRIPTION
A permanent easement more particularly described as follows:
Beginning at the Southeast 'Corner of Lot 9, Block 2, Resler & Miller's
Addition and running thence West 8' , thence North 85' , thence West 7' , thence
North 60' , thence East 15' to the Northeast Corner of Lot 9,, thence South 145'
-to the point of beginning. All located in the City of Ames, Story County, Iowa
and containing 0.036 acres.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City's failure to use due
care in its exercise of the rights granted.
