RIGHT OF WAY PERMIT AND EASEMENT
We, Hazel B. Rood, single, Lois Ann Hovick, and Theory
Hovick, wife and husband, Orman Overland and Helen L. Overland,
husband and wife, and Alma Overland, single, in consideration of
the sum of One Dollar and other valuable considerations, the
receipt whereof is hereby acknowledged, do hereby grant unto
the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the right to enter upon the following described
lands:
1. The East Half of the Northeast fractional Quarter
of Section 1, Township 83 North, Range 24 West of
the 5th P.M. , Iowa, and
2. The Southeast Quarter of the Southwest Quarter of
the Northeast Quarter of Section 1, Township 83
North, Range 24 West of the 5th P.M. , Iowa,
and the perpetual right to construct, reconstruct, clean up,
operate, maintain, cover over and repair a sanitary sewer upon`,
under and across the above described, lands for a distance of
ten (10) feet on each side of said sewer line located upon the
lands above described in approximately the following line:
1. Beginning at a point on the West line of the East
half of the Northeast fractional Quarter of Section
1, Township 83 North, Range 24 West of the 5th P.M. ,
Iowa, 850 r feet North of the Southwest corner
thereof, thence North 830 041 East 358.3 feet,
thence South 620 131 East 263.6 feet, thence
South 89 571 East 273.1 feet; thence North 270
271 East 245 feet, thence South 880 311 East 181
feet, thence North 310 061 East 137.9 feet to the
West line of the County road, and
2. Beginning at a point on the West line of the
Southeast Quarter of the Southwest Quarter of
the Northeast Quarter of Section 1, Township 83
North, Range 24 West of the 5th P.M. , Iowa, 500r
feet North of the Southwest corner thereof,
thence North 490 121 East 147.4 feet, thence
North 710 181 East 255 feet to the North line
thereof,
along with the perpetual right to cut, clean up and remove any and
all trees and brush necessary in the construction, operation,
maintenance and repair of said sewer line.

There is also hereby granted a temporary easement and right
of encroachment over and across an additional thirty (30) feet
on the south side of the above described sewer line for construction
purposes until October 1, 1960, together with the right to out,
clean up, and remove any and all trees and brush necessary in
the construction of said sewer line.
As a part of the consideration for this agreement the
City of Ames, Iowa, agrees to do and perform the following:
1. All trees and brush cut in the exercise of the above
rights shall be removed from the above described premises or
burned upon the above right of way granted.
2. To allow the grantors, their successors and assigns,
to make one single connection to said sanitary sewer for service
to one single building only, without charge, and one single 3/4
inch corporation cock tap to the water main along the East side
of the road adjacent to the land above described, without cost,
subject, however, to said connection being made in accordance
with the laws, regulations and ordinances of the City of Ames,
Iowa.
3. In event the above described real estate is annexed
to and becomes a part of the City of Ames, Iowa, to allow the
grantors, their successors and assigns to make additional con-
nections to said sanitary sewer at a charge of $250.00 for
each single building, connected directly or by way of laterals,
to said sanitary sewer, or at a charge of $2.50 per front foot
of land abutting upon each side of said sewer line, whichever
is greater, but in no event shall the total charges for such
sewer connections exceed $12,000.00 for the entire area above
described. All such connections shall be made in accordance
with the laws, regulations and ordinances of the City of Ames,
Iowa.

4. To assume all liability for all damages to the above
described property caused by the City' s failure to use due care
in the exercise of the rights granted.
IN WITNESS WHEREOF, the parties have hereunto subscribed
