Gy, husband and wife; Richard Coy and Gretchen Coy, husband and wife; Richard K. Bliss and Patricia L. Bliss, husband and wife; Milford A. Fjare and Maxine Fjare, husband and wife; and Paul S. Fjara and Marian Ann Fjare, husband and wife, of Ames, Story County, Iowa, in con- sideration of the sum of One Dollar, receipt of which is hereby acknowledged, do hereby grant to the City of Armes, Iowa, a municipal corporation, its sue- cessors and assigns, the perpetual right to construct, reconstruct, maintain, and use its underground sanitary sewer system within the boundaries of the following described real estate: The blest 5 Feet of Lots 4, 15, 22 and 33; The East 5 Feet of Lots 3, 16, 21, 34 and 40; 5 Feet along the Northwest side of Lots 38 and 4T; 5 Feet along the Southeast side of Lots 39 and 46; all within Broadmoor Third Addition to Ames, Iowa. The foregoing right is granted upon the express condition that the City of Ames will assume liability for all damage to the herinbefore described property caused by the said City's failure to use due care in its exercise of the granted right.
