Roberson and Laura T. Roberson, husband and wife, in consideration of the sum of One Dollar and other valuable consideration, the receipt whereof is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, -a municipal corporation, its successors and assigns, the right to enter upon the land de- scribed as: That portion of the West Half of the West Half of the Southeast Quarter of Section 1 lying North of the. Chicago Northwestern Railroad Company right of way, and the Southwest Quarter of the Southwest Quarter of the Northeast Quarter of Section 1, all in Township 83 North, Range 24 West of the 5th P.M. , Iowa, and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover over and -repair a sanitary sewer upon, under and across said land for a distance of tern (10) feet on each side of said sewer line located upon the land above described in approximately the following line: Beginning at a point on the West line of the Southeast Quarter of Section 1 Township 83 North, Range 24 West of the 5th P.M. , at its intersection with the North right of way line of the Chicago Northwestern Railway Company, thence North 27 feet, thence North 180 20' East 419. 6 feet, thence North 130 09' East 768. 4 feet, thence North 490 12' East 402 feet to the East line of the Southwest Quarter of the Southwest Quarter.of the Northeast Quarter of said Section 1. There is hereby granted also a temporary easement over and across an additional 30 feet on the East side of said sewer line for construction purposes until August 1, 1966. The foregoing right is granted upon the express condition that the City of Arne s, Iowa will assume liability for all damages to the above described property caused by said City's failure to use due care in its exercise of the right granted. Roberson, husband and wife, to me known to be the parties mentioned in the above grant and who executed the same and acknowledged that they executed the same as their voluntary , ``N A G '"'Act and deed, Y: Notary Public in for Story County, Ia. 800 PAG i MEMORANDUM AND AGREEMENT In consideration of George Roberson and Lillian Roberson, husband and wife, granting to the City of Ames, Iowa an easement in connection with the water main over and across the following described real estate: That portion of the West Half of the West Half of Section 1 lying North of the Chicago, Northwestern Railroad Company rim of way, and the Southwest Quarter of the Southwest Quarter of the Northeast Quarter of Section 10 all in Township 83 North, Range 24 West of the 5th P.M., Iowa, the City of Ames does hereby agree to allow the said George Roberson and Lillian Roberson, their successors and assigns, to make one single 3/4 inch corporation cock tap to said water main without charge, subject, however, to said connection being made in accordance with the laws, regulabions and ordinances of the City of Ames, Iowa.
