Granquist and Margaret Granquist, husband and q g q wife, in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, do hereby .grant unto the. City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described as: Lot 6, Block 1, Wearth's Addition to the City of Ames, Iowa, and the perpetual right-to-construct,, recondtruct, clean up, .operate, maintain, cover over and ,repair a sanitary sewer upon, under and across said land described as follows Beginning at the Southwest Corner, Lot 6, Block 1 Wearth's_ Addition to the City of Ames, Iowa, thence North 12 feet along the West line of said Lot 6, thence East 95 feet, _thence South 12 feet, thence West 95 feet along the South line of said Lot 6 to the point of beginning. There is hereby granted also a temporary easement over and across an additional 12 feet on the North side of said sewer line for construction purposes. The foregoing right is granted upon the express condition that the City of Ames.. Iowa will assume liability for all damages to the above described property caused by said City's failure to use due care in its exercise of the right granted, and will repair the road adjacent to said sewer if damaged. MEMORANDUM OF AGREEMENT. In consideration of Norman R. Granquist and Margaret A. Granquist, husband and wife, granting unto the City of Ames, Iowa a perpetual easement for sanitary sewer purposes over, under and across certain lands owned by them, and for the purposes of the Cherry and Borne Street sanitary sewers, the parties hereto hereby agree as follows: 1. That the City of Ames, its agents and contractors, will be permitted to remove say trees necessary for the construction of the said sanitary sewer. 2. That the City of Ames, its agents and contractors, will be permitted to use Lot 6, Block 1, Wearth's Addition to the City of Ames to park equip- ment during the period of construction. 3. That the City of Ames will relocate and replace the driveway in front of Lot 6, Block 1, Wearth's Addition to the City of Ames, Iowa. 4. That the City of .Ames will re-sod axW grass areas that are damaged on the property of the said Norman R. Granquist and Margaret A. Granquist. Dated at Ames, Iowa this •- -day of July, 1961.
