HomeMy WebLinkAbout~Master - Sanitary Sewer - Earl Freel and Roxie Freel R tiZi...w Instr. #1' 40 Fee $ RIGHT OF WAY PERMIT AND EASEMENT We, Earl Freel and Roxie Freel, husband and wife, in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described as: The North 100 feet of the West 150 feet of the East 450 feet of the Northeast Quarter of Section 11, Township 83 North, Range 24 West of the 5th P. M. , Iowa, and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover over and repair a sanitary sewer upon, under and across said land as follows: 5 feet on each side of a line beginning at a point 50 feet South and 300 feet West of the Northeast corner of Section 11, Township 83 North, Range 24 West of the 5th. P. M. , Iowa, thence West 150 feet. There is hereby granted also a temporary easement over and across an additional 12 feet on the North side of said sewer line for .construction parpgse The foregoing right is granted upon the express condition tbAt the City of. Ames, Iowa will assume liability for all damages to the above described pro- perty caused by said City's failure to use due care in its exercise of the right granted, and will repair the road adja t to said sewer if damaged.
