Collins , Husband and Wife, in consideration of the sum of one dollar, receipt of which is hereby acknowledged, does hereby grant to the City of Ames, Iowa, a Municipal Corporation, its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain and use its underground electric lines, wires, cables and other similar equipment or any part thereof for the sole purpose of conveying electric current for power and lighting purposes underground of the real estate described as follows: The north 8 feet of Lot 2, of Lot 11, SEA, SW—;, Seca 5, Township 83" Range 24 W of the 5th P.M. Ames, Story County. Iowa. together with a temporary right to provide overhead electrical service in event of emergency. - The foregoing rights are granted upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said City's failure to use due care in its exercise of the granted rights.
