ACE 39� In st. �E 1654 •_ 7... t Fee: S 2. 50 ELECTRIC UTILITY EASEMENT Methodist Ministers` Service Credit Union, a corporation formed under the laws of Iowa, in the consideration of One Dollar, receipt of which is hereby acknowledged, grants to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain and use its overhead and underground electrical lines, wires, cables, anchors and other similar equipment or any part thereof, for the purpose of conveying electrical current for power and lighting purposes overhead and underground on the following described real estate: The North 5 feet of the East 248 feet of the West 298 feet and the East 10 feet of the West 198 feet of the North 180 feet of the South 1/2 of the North 1/2 of the South- west 1/4 of the Southeast 1/4 of Section 11, Township 83 North, Range 24 West of the 5th P.M., Ames, Story County, Iowa . Said easement is shown as a shaded section on the attached Exhibit A. No trees shall be planted in the easement and the City of Ames shall not be liable for ornamental shrubbery in the ease- ment in the event of underground distribution construction or repairs. Rights for trimming trees adjacent to this easement, sufficient for safe operation of overhead electrical lines, shall be granted. Structures built on the property shall provide electrical clearances meeting the requirements of the National Bureau of Standards Handbook No. 81, or latest revision thereof, for safety. These rights are granted upon the express condition that the City of Ames shall assume liability for all damages to the hereinbefore described real estate caused by the City' s failure to use due care in the exercise of its said right.
