Hunziker, husband and wife, and Donald M. Furman and Ruth W. Furman, husband and wife, of Ames, Story County, Iowa, in consideration of the sum of One Dollar, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, recon- struct, maintain and use its electric lines, consisting of poles, wires , overhead or underground cables, fixtures, anchors, and other similar equipment, or any part thereof, upon, underground, over or across the following described real estate: The East 5 feet -of Lots 1,3,10, and 15; The North 5 feet of Lots 1,2,3, and 4; The South 5 feet of Lots 10,13,14, and 15 The West 5 feet of Lots 6 and 7; Five feet adjacent to the northeasterly boundary of Lot 7; Five feet adjacent to the northerly boundary of Lots 5 and 6; Five feet adjacent to the southerly boundary of Lots 9, 11, and 12; Five feet adjacent to the easterly boundary of Lots 5 and 11; Five feet adjacent to the westerly boundary of Lots 4 and 12; Five feet adjacent to the rear lot line of Lots 8 and 9; A tract 5 feet wide, centered on the southwesterly boundary of Lot 7, and extending 25 feet southeasterly from the southwesterly corner of Lot 7; The East 13 feet of the 5 feet adjacent to the northerly boundary of Lot 10, all within Ninth Addition Ontario Heights Subdivision of Ames, Iowa , for the sole purpose of conveying electric current for power and lighting purposes, together with the right to trim any trees to allow for clearance of at least four feet, where necessary, for the safe operation and use of overhead electric lines. ' We further grant to the City of Ames , Iowa, the right to permit other utility companies to construct, and in the same manner, maintain its utility facilities, jointly or severally, upon, underground, over or across the real estate as described above. The foregoing right is granted upon the express condition HEGLAND, that the City of Ames will assume liability for all damage to NEWBROUGH & the hereinbefore described real estate caused by the City's JOHNSTON AMES.
