RIGHT OF WAY PERMIT AND EASEMENT
We, Erben A. Hunziker and Margaret H. Hunziker, husband
and wife, and Donald M. Furman and Ruth W. Furman, husband and
wife, of Ames, Story County, Iowa, in consideration of the sum of
One Dollar, receipt of which is hereby acknowledged, do hereby
grant to the City of Ames, Iowa, a municipal corporation, its
successors and assigns, the perpetual right to construct, recon-
struct, maintain and use its electric lines, consisting of poles,
wires, overhead or underground cables, fixtures , anchors, and
other similar equipment, or any part thereof, upon, underground,
over or across the following described real estate:
The North 5 feet of Lots 1, 2, 6 and ].7
The South 5 feet of Lots 3 and 4
The West 5 feet of Lot 27
Five feet adjacent to the easterly boundary of Lots 1 & 4
Five feet adjacent to the westerly boundary of Lots 2 & 5
Five feet adjacent to the northeasterly boundary of Lots 7,
9, 10, 11 17 and 18
Five feet adjacent to the southwesterly boundary of Lots 8 & 12

18 19 20 21 22 23 24 25 26 and 27

Also a tract of land 5 feet in width, extending 25 feet south-
easterly from the northeast corner of Lot 6 and centered on the
southwest rly 1poundar of Lot 7, all within Fifth Addition, North

and lighting purposes, together with the right to trim any trees
to allow for clearance of at least four feet, where necessary,
for the safe operation and use of overhead electric lines. We
further grant to the City of Ames, Iowa, the right to permit
other utility companies to construct, and in the same manner,
maintain its utility facilities, jointly or severally, upon,
underground, over or across the real estate as described above.
The foregoing right is granted upon the express condition
that the City of Ames will assume liability for all damage to
the hereinbefore described real estate caused by the City's
failure to use due care in its exercise of the granted right.

personally appeared Erben A. Hunziker and Margaret H. Hunziker,
husband and wife, and Donald M. Furman and Ruth W. Furman, hus-
band and wife, personally known to me to be the identical persons
named in and who executed the foregoing instrument and acknowledge
that they executed the same as their voluntary act and deed.
