RIGHT-OF-WAY PERMIT AND EASEMENT
We, Paul Uthe and Evelyn Uthe, husband and wife, of Story County,
Iowa, in consideration of the sum of One Dollar, receipt of which is hereby
acknowledged, do hereby grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to construct,
reconstruct, maintain, operate and use its electric utility anchors and
cables for its electric utility lines and poles, together with the right to trim
any trees where necessary to secure adequate clearance therefor, over
and across the real estate described as follows:
A parcel of land commencing 33 feet North and 64 feet
East of the center of Section 28, thence North 40 feet,
thence East 10 feet, thence South 40 feet, thence West
10 feet to the point of beginning, and a parcel of land
commencing 33 feet North and 175 feet East of the
center of Section 28, thence North 40 feet, thence East
10 feet, thence South 40 feet, thence West 10 feet to
the point of beginning, all in Township 84 North, Range
24 West of the 5th P. M., Iowa.
The foregoing right is granted upon the express condition that the
City of Ames will assume liability for all damage to the hereinbefore describe
property caused by the said City's failure to use due care in its exercise of the
granted right.
