Gammack and Ruth Gammack, husband and wife, in consideration of the sum of one dollar, receipt of which is hereby acknowledged does hereby grant to the City of Ames, Iowa, a Municipal Corporation, its successors and assigns, the perpetual right to construct, reconstruct, repair, maintain and use its underground electric lines, wires, cables and other simi- lar equipment or any part thereof for the sole purpose of conveying electric current for power and lighting purposes undergr&dnd of-the real estate des- cribed as follows: A part of Lot 89, Ridgewood Addition to Ames, Iowa, described as follows: 5 feet in width the centerline of which is described as follows: Beginning at a point on the Easterly side of Lot 89, at a point 2. 5 feet Southeasterly of the northerly corner of said Lot, thence in a Southwesterly direction on an angle of 1220 401, as measured from the Northeasterly corner of Lot 87, a distance of 204 feet; thence an easement 10 feet in width the centerline of which is as follows: thence at an angle to the Left of 840 401, a distance of 24 feet to an existing pole. The foregoing rights are granted upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said City's failure to use due care in its exercise of the granted rights.
