RIGHT OF WAY PERMIT AND EASEMENT
We, Fred H. Logsdon and Birdie Logsdon, husband and wife, of
Story County, Iowa, for ourselves, successors and assigns, in consideration
of the sum of One Dollar and other good and valuable consideration, receipt
of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa,
a municipal corporation, its successors and assigns, the perpetual right to
construct, reconstruct, maintain, repair, and use its electric lines, con-
sisting of poles, wires, overhead cables, fixtures, anchors, and other
similar equipment, or any part thereof for the sole purpose of constructing g
69, 000 volt power line and other electric lines for conveying electric
current for power and lighting purposes, together with the right to extend
to any telephone, electric or power company the right;to use jointly with the
grantee any pole placed pursuant to the provisions hereof, and together with
the right to trim any trees or remove any trees where necessary to secure
adequate clearance for the safe operation of the electric lines upon or across
the following described real estate, to-wit:
The West 100 feet of the Northwest Quarter of Section 1,
Township 83 North, Range 24 West of the 5th P. M. , Iowa,
except Thirteenth Street right of way on the north thereof.
It is further agreed by the undersigned that no new trees shall be
planted or maintained on said right of way, and that no buildings or other
structures shall be built under the said utility lines nor within the distances
prohibited by the National Electric Safety Code (National Bureau of Standards
Handbook No. 81) or latest revisions thereof.
The foregoing rights are granted upon the express condition that the
City of Ames will assume all damage to the hereinbefore described property
caused by the city's failure to use due care in its exercise of the rights
granted; and, that the City will pay for all crop damage during construction,
maintenance and repair on said premises.
