RIGHT OF WAY PERMIT AND BASEMENT
That Del-Development Co. of Ames, Story County, Iowa, in
consideration of the sum of One Dollar, receipt of which is hereby
acknowledged, does hereby grant to the City of Ames, Iowa, a muni-
cipal corporation, its successors and assigns, the perpetual right
to construct, reconstruct, maintain and use its electric lines,
consisting of poles, wires, overhead or underground cables, fix-
tures, anchors and other similar equipment, or any part thereof,
for the sole purpose of conveying electric current for power and
lighting purposes, together with the right to use jointly with
the grantees, any pole placed pursuant to the provisions thereof,
together with the right to trim any trees to allow for clearance
of at least four feet, where necessary, to secure adequate clear-
ance for the safe operation of the electric lines, upon, under-
ground, or adjacent to that certain piece of real estate, described
as:
The East 6 feet of Lot 1;
The South 5 feet of Lots 1, 2, 3, and 4;
The East 7.5 feet of Lots 7, 8 and 9;
The North 5 feet of Lots 5, 6 and 7;
The South 7.5 feet of Lots 9 and 10;
The East 5 feet of Lot 10;
Also a 7.5 feet x 25 feet strip projecting
North 25 feet and West 7.5 feet from a point
52.8 feet )West of the most eastern southeast
corner of Lot 9;
Also a 7.5 feet x 25 feet strip projecting
West 25 feet and North 7.5 feet from a point
52.8 feet West of the most eastern southeast
corner of Lot 9,
all within and as shown on the final plat of Del Subdivision of thE
City of Ames, Iowa. The foregoing is granted upon the express
condition that the City of Ames will assume liability for all
damage to the hereinbefore described real estate caused by the
City' s failure to use due care in its exercise of the granted right .

On this day of April, 1965, before the undersigned, a
Notary Public in and for Story County, Iowa, appeared Delmar
Fanning and Matilda Fanning, to me personally known, who, being
first duly sworn, did say that they are respectively the President
and Secretary of Del-Development Co. ; that no seal has been
procured by the said corporation; that said instrument was signed
on behalf of said corporation by authority of its Board of Direc-
tors and the said Delmar Fanning and Matilda Fanning acknowledged
the execution of the above instrument to be the voluntary act and
d6ed, of said corporation.
