Moore, husband and wife, of Ames, Story County, Iowa, in consideration of the sum of One Dollar receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its electric lines, consisting of poles, wires, overhead or underground cables, fixtures, anchors and other similar equip- ment, or any part thereof, for the sole purpose of conveying electric current for power and lighting purposes, together with the right to extend to any telephone, electric, gas or power company the right to use jointly with the grantees, any pole placed pursuant to the provisions thereof, together with the right to trim any tree to allow for clearance of at least four feet, where necessary to secure adequate clearance for the safe operation of the electric lines, upon, underground, or adjacent to that certain piece of real estate described as: The South 5 feet of Lots 1 and 2; The East 5 feet of Lot 1; The West 5 feet of Lots 2 and 3; The North 5 feet of Lot 3; and The East 10 feet of the North 10 feet of Lot 3, all within Moore' s Seventh Addition Country Club Heights, Ames, Iowa. The foregoing right is granted upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore described real estate caused by the said City' s failure. to use due care in its exercise of the granted right.
