RIGHT OF WAY PERMIT AND EASEMENT
THE UNDERSIGNED, Phil Coy and Sons, a partnership composed
of Jack Coy and Richard Coy; Jack Coy and Elizabeth E. Coy, husband and
wife; Richard Coy and Gretchen Coy, husband and wife; Richard K. Bliss
and Patricia L. Bliss, husband and wife; in consideration of the sum of
One Doll-:r and other considerations, receipt of which is hereby acknowledged,
do grant to the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, reconstruct, maintain and
use electric lines, consisting of poles, wires, cables, conduits, fixtures,
anchors and other similar equipment, including the right to trim or remove
trees within such area where necessary to secure a clearance of 4 feet from
the wires or poles, together with the right to extend to telephone, telegraph,
electric or power companies, or a company, the right to use separately or
jointly with the City of Ames the areas included in this easement for the
purposes above enumerated, over, upon, across or under the following des-
cribed real estate, situated in the County of Story, State of Iowa, to-wit:
The East 5 feet of Lots 2, 3, 4, 5, 6, 7, 11, 12, 14, 15, and 16;
A 5 foot strip adjacent to and parallel toghe Northwest boundary
The West 5 feet of Lot 17; / line of Lot 7.,
The North 5 feet of Lots 1, 21% 13, 16, and, 17, and 5
A 5 foot strip adjacent to and parallel to the rear boundary lines
of Lots 8, 9, 10, 11, 12, and 18;
A 5 foot strip adjacent to and parallel to the Southeast boundary
The South 5 feet of Lots 3, 14 and 18, and 6; /line of Lot 9,
All of said lots being located in Broadmoor Sixth Addition to Ames,
Iowa.,
The foregoing right is granted upon the express condition that the
City of Ames will assume responsibility for all damage to the above des-
cribed property caused by the City's failure to use due care in the exercise
of its granted right, except that the City shall not be liable for damages to
shrubs, bushes and trees on the easempjit areas.

Jack Coy and Richard Coy, Jack Coy and Elizabeth E. Coy, husband and
wife; Richard Coy and Gretchen Coy, husband and wife; and Richard K.
Bliss and Patricia L. Bliss, husband and wife, personally known to me to
be the identical persons whose names are affixed to the foregoing instrument
and acknowledged that they executed the same as their voluntary act and
deed.
