RIGHT OF WAY PERMIT AND EASEMENT
We, John W. Moore and Opal I. Moore, husband and wife, of
Ames, Story County, Iowa, in consideration of the sum of One
Dollar, receipt of which is hereby acknowledged, do hereby grant
to the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, reconstruct, maintai
and use its electric lines, consisting of poles, wires, overhead
or underground cables, fixtures, anchors, and other similar equipmezit,
or any part thereof, upon, underground, over or across the following
described real estate:
The West 5 feet of Lots 10, 11, 12, and 13;
Five feet adjacent to the Easterly boundary of
Lots 1, 21 3, 4, 5 and 6;
Five feet adjacent to the Northerly boundary of
Lots 1,:. j and 9;
Five feet adjacent to the Southerly boundary of
Lots 2, 3, 4, 51 11, and 13;
Five feet adjacent to the Westerly boundary of
Lot 7;
Five feet adjacent to the Easterly boundary of
Lot 8;
That part of Lot 7 described as a tract 5 feet
wide extending 25 feet East from the Northeast
corner of Lot 8 and centered on the North line
of Lot 8;
That part of Lot 3 described as a tract 5 feet
wide extending. 25 feet due west from the most
westerly point of tht`# &sterly bounds�v off LI,Qc�t 3;
That part of Lot 2 lying South and Sou as
of a line beginning at a point 5 feet North of
the Northeast corner of Lot land terminating
at a point in the Easterly boundary of Lot 2 and
15 feet Northerly from the Southeast corner of
Lot 2,
Ten feet adjacent to the Northerly boundary of Lot 6,
all within Moore's Tenth Addition, Country Club Heights Subdivision
Ames, Iowa,
for the sole purpose of conveying electric current for power
and lighting purposes, together with the right to trim any trees
to allow for clearance of at least four feet, where necessary,
for the safe operation and use of overhead electric lines. We
further grant to the City of Ames , Iowa, the right to permit
other utility companies to construct, and in the same manner,
maintain its utility facilities, jointly or severally, upon,
underground, over or across the real estate as described above.

The foregoing right is granted upon the express condition
that the City of Ames will assume liability for all damage to
the hereinbefore described real estate caused by the City's
failure to use due care in its exercise of the granted right.
