Flummerfelt and AFlummerfelt, husband and wife, of Story County, Iowa, for ourselves, successors and assigns, in consideration of the sum of One Dollar and other good and valuable consideration, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain, repair, and use its electric lines, consisting of poles, wires, overhead and/or underground cables, fixtures, anchors, and other similar equipment, or any part thereof for the sole purpose of constructing an electric power line for conveying electric current for power and lighting purposes, together with the right to extend to any telephone company, the right of use jointly with the grantee any pole placed pursuant to the provisions hereof, and together with the right to trim any trees or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the following described real estate, to-wit: A parcel of land consisting of the North 6 feet of the East 1 ,018. 5 feet and the East 5 feet, and the South 6 feet, of the East 1 ,120 feet, of the South 1/2, of the North 1/2, of the Southwest 1/4, of the Southeast 1/4, of Section 11 , Township 83 North, Range 24 West, of the 5th P.M. , Ames, Story County, Iowa. Also, a parcel of land 10 feet in width, centered on and extending from a point 335 feet West of the Northeast corner to a point 343 feet West of the Southeast corner of the South 1/2 of the North 1/2, of the Southwest 1/4, of the Southeast 1/4, of Section 11 , Township 83 North, Range 24 West, 5th P.M. , Ames, Story County, Iowa. Also, an 8 foot parcel of land located 163 feet South of the North point and centered on a line at an angle of 89035' with the centerline of the preceding parcel and extending Westerly 118 feet and Easterly 85 feet. Also a parcel of land 10 feet in width, centered on and extending from a point 793 feet West of the Northeast corner to a point 786 feet West of the Southeast corner of the South 1/2 of the North 1/2 of the Southwest 1/4, of the Southeast 1/4, of Section 11 , Township 83 North, Range 24 West, 5th P. M. , Ames, Story County, Iowa. Also, an 8 foot parcel of land located 68 feet South and an 8 foot parcel of land located 200 feet South of the North point and centered on a line at an angle of 90 degrees with the centerline of the preceding,parcel, each extending Easterly 150 feet, the North parcel 150 feetfsterly and the South parcel 200 feet Westerly. It is further agreed by the undersigned that no new trees shall be planted or maintained on said right-of-way, and that no buildings or other structures shall be built under the said utility lines nor within the distances prohibited by the National Electric Safety Code (National Bureau of Standards Handbook No. 81) or latest revisions thereof. The foregoing rights are granted upon the express condition that the City of Ames will assume all damage to the hereinbefore described property caused by the City's failure to use due care in its exercise of the rights granted during construction, maintenance and repair on said premises.
