ELECTRIC UTILITY EASEMENT
Concrete Products of Ames, a corporation formed under the laws of Iowa,
in consideration of one dollar, the receipt of which is hereby acknowledged, grants
to the City of Ames, Iowa, a Municipal Corporation, its successors and assigns,
the perpetual right to construct, reconstruct, repair, maintain and use its overhead
and underground electrical lines, wires, cables, anchors and other similar equip-
ment or any part thereof, for the purpose of conveying electrical current for power
and lighting purposes overhead and underground on the following described real
estate:
The West 5 feet of the North 40 rods of the East 8 rods of the
k' T y-,,, l w8sttsne-quarter of the Northeast one-quarter of Section 1,
Township 83 North, Range 24 West of the 5th P. M. , Ames, Story
County, Iowa.
Said easement is shown as a shaded section on Exhibit A attached.
No trees shall be planted in the easement and the City of Ames shall not be
liable for ornamental shrubbery in the easement in the event of underground dis-
tribution construction or repairs. Rights for trimming trees adjacent to this
easement, sufficient for safe operation of the overhead electrical lines shall be
granted.
Structures built on the property shall provide electrical clearances meeting
the requirements of the National Bureau of Standards Handbook No. 81, or latest
revision thereof, for safety. No new structures shall be built tinder the lines nor
within limits prohibited by said Handbook No. 81.
These rights are granted upon the express condition that the City of Ames
shall assume liability for all damages to the hereinbefore-described real estate
caused by the City's failure to use due care in the exercise of its said rights.
