RIGHT ,OF WAY PERMIT AND EASEMENT
We, Phil Coy & Sons, a partnership composed of Jack Coy and
Richard Coy; Jack Coy and Elizabeth E. Coy, husband and wife; Richard Coy and
Gretchen Coy, husband and wife; Richard E. Bliss and Patricia L. Bliss, husband
and wife; Milford A. Fjare and Maxine Fjare, husband and wife; and Paul S. Fjare
and Marian Ann Fjare, husband and wife, of Ames, Story County, Iowa, in con-
sideration of the sum of One Dollar, receipt of which is hereby acknowledged,
do hereby grant to the City of Ames, Iowa, a municipal corporation, its success rs
and assigns, the perpetual right to construct, reconstruct, maintain, and use
its electric lines, consisting of poles, wires, overhead or underground cables,
fixtures, anchors and other similar equipment or any part thereof, for the sole
purpose of conveying electric current for power and lighting purposes, together
with the right to extend to any telephone, electric or power company, the right
to use jointly with the grantee, any pole placed pursuant to the provisions
hereof, together with the right totrim any trees to allow for a clearance of
at least four feet where necessary to secure adequate clearance for the safe
operation of the electric lines, upon, underground, or adjacent to that certain
piece of real estate described, as follows:
The South 5 Feet of Lots 1, 21 31 49 5, 61 7, 8, 91 19, 20,
21, 22, 23, 24, 25, 26, 27 and 41;
The forth 5 Feet of Lots 10, 11, 12, 13, 14, 15, 16, 17, 18
and 35;
The East 5 Feet of Lots 7, 16, 13 and 51;
The West 5 Feet of Lots 2, 5, 10, 20, 23, 27, 30, 31 and 42;
5 Feet along the Northwest side of Lots 30, 34, 42, 43, and 44;
(; 5 Feet along the Northeast side of Lots 26, 31, 32, 33, 41, 44,
45, 46, 47, 48, 49, 50 and 51;

5 Feet along the Southwest side of Lots 28, 29, 36, 37, 36 and 39;

5 Feet either side of a line running Forth 450 hest from the
point of intersection of the rear lot lines of Lot 40, running

all in Broadmoor Third Addition, Ames, Iowa.
The foregoing right is granted upon the express condition that the
City of Ames will assume liability for all damage to the hereinbefore described
property caused by the said City's failure to use due care in its exercise of
the granted right. &

wife; Richard K. Bliss and Patricia L. Bliss, husband and wife; Milford A. Fjar(
and Maxine Fjare, husband and wife; and Paul S. Fjare and Marian Ann Fjare,
husband and wife; personally known to be the identical persons named in and who
executed the foregoing instrument and acknowledged that they executed the same
as, their voluntary act and deed.
