RIGHT OF WAY PERMIT AND EASEMENT
We. Erben A. Hunziker and Margaret H. Hunziker, husband and wife,
and Donald M. Furman and Ruth W. Furman, husband and wife, of Ames, Story
County, Iowa, in consideration of the sum of One Dollar, receipt of which is
hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to construct,
reconstruct maintain and use its electric lines 9 consisting of poles, wires
overhead or underground cables, fixtures, anchors and other similar equipment
or any part thereof, for the sole purpose of conveying electric current for
power and lighting purposes, together with the right to extend to any telephone,
electric or power compay the right to use jointly with the grantee, any pole
placed pursuant to the provisions hereof, together with the right to trim any
trees to allow for a clearance of at least four feet where necessary to secure
adequant clearance for the safe operation of the electric lines, upon, under-
ground, or adjacent to that certain piece of real estate described as follows:
North 5 feet of Lots 1, 2, 3, 4, 5, 6, 7 and 8;
South 5 feet of Lots 10, 11, 12, 13, 14, and 15;
West 5 feet of Lots 1 and 15;
all in Ninth Addition, Melrose Park Subdivision, Ames, Iowa.
The foregoing right is granted upon the express condition that the
City of Ames will assume liability for all damage to the hereinbefore described
property caused by the said City's failure to use due care in its exercise of
the granted right.
