RIGHT-OF-WAY PERMIT AND EASEMENT

We, Erben A, Hunziker and Margaret H. Aunziker, husband
and wife, Donald M. Furman, single, and Glen Lowman and Dorothea
Lawman, husband and wife, all of Story County, Iowa, in consider. 4
ation of the sum of One ($1.00) Dollar and other valuable considerev
lations, receipt of which is hereby acknowledged, do hereby grant
to the City of Asses, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, re-construct,
maintain and use its electric lines, consisting of poles, wieres,
overhead or underground cables, fixtures, anchors, and other
similar equipment, or any part thereof, for the sole purpose of
conveying electric current for power and lighting purposes, to-
gether with the right to extend to any telephone, electric or
power company the right to use jointly with the grantee any pole

placed pursuant to the provisions hereof, together with the right
to trim any trees where necessary to secure adequate clearance
for the safe operation of the utilities upon, underground or
adjacent to the East 10 feet of the following described real estate,*

The foregoing right is granted upon the express cones
dition that the City of Ames will assume liability for all damage
to the hereinbefore described property caused by said city's
failure to use due care in its exercise of the granted right„
