RIGHT OF WAY PERMIT AND EASEMENT X
We, John W. Moore and Opal I. Moore, husband and wife, of Story County,
Iowa, in consideration of the sum of One Dollar ($1.00) and other valuable
consideration, receipt of which is hereby acknowledged, do hereby grant to the
City of Ames, Iowa, a municipal corporation, its successors and assigns, the
perpetual right to construct, reconstruct, maintain, and use its electric
lines, consisting of poles, wires, overhead or underground cables, fixtures,
anchors, and other similar equipment or any part thereof, for the sole purpose
of conveying electric current for power and lighting purposes, together with
the right to extend to any telephone, electric or power company the right to
use jointly with the grantee any pole placed pursuant to the provisions hereof,
together with the right to trim any trees where necessary to secure adequate
clearance for the safe operation of the electric lines upon, underground or
adjacent to the following described real estate: - /
The North 5 feet of Lots 2, 3, 4, 5 and eVP1s - GGsc.�
The South 10 feet of Lots 7, 8, 9, 10 and I*
. within Moore's Fifth Addition Country Club Heights, Ames, Iowa.
The foregoing right is granted upon the express condition that the City
of Ames will assume liability for all damage to the hereinbefore described pro-
perty caused by said city's failure to use due care in its exercise of the
granted right.
