RIGHT OF WAY PERMIT AND EASEMENT
We, Erben 1junziker and Margaret ;H. Hunziker, ,husband
and wife, and Donald 11�. urmantisdgebs,, of Story County, Io*a,
in consideration of the sim of One Dollar ($1.00), receipt of whit
is hereby acknowledged, do hereby grant to the City of Ames, Iowa,
a municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain, and use its electric
lines, consisting of poles, wires, overhead or underground cables,
fixtures, anchors, and other similar equipment or any part thereof,,
for the sole purpose of conveying electric current for power and
lighting purposes, together with the right to extend to any
telephone , electric or power company the right to use jointly
with the grantee, any pole placed pursuant to the provisions
hereof, together with the right to trim any trees where necessary
to secure adequate clearance for the safe operation of the electric
lines upon, underground, or adjacent to that certain piece of real
eatate hereinafter described in the following manner:
10 feet across the Southwest boundary of Lots
1, 2, 39 4, and 5,
The West 10 feet of Lots 6, 7, 8, 9 and 10,
The East 10 feet of Lots 11, 12, 13, 14 and 15, and
10 feet across the Northwest and the Southeast and
the North boundary of Lot l6,
all in Second Addition, Melrose Park Subdivision to Ames, Iowa.
The foregoing right is granted upon the express condition
that the City of Ames will assume liability for all damage to the
hereinbefore described property caused by the said city's failure
to use due care in its exercise o the granted right.
