Jensen, husband and wife, of Story County, Iowa, in consideration 'of the sum of One Dollar ($1.00) , receipt of which is hereby acknowledged, do hereby grant to the City of 'Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, main- tain, and use its electric lines, consisting of poles, wire, overhead or underground cables, fixtures, anchors, and other similar equipment or any part thereof, for the sole purpose of conveying electric current for power and lighting purposes, togetbe with the right to extend to any telephone, electric or power company the right to use jointly with the grantee, any pole placed pursuant to the provisions hereof, together with the right to trim any trees where necessary to secure adequate clearance for the safe operation of the electric lines, upon, underground, or adjacent to that certain piece of real estate hereinafter described in the following manner: Commencing at the northwest corner of Lot 1. Highland Park First Addition to Ames, Iowa, on the east line of the west half of the west half of the Southwest Quarter of the Northwest Quarter of Section 35, Township 84 north, Range 24 west of the 5.�h:;P,M,M, Iowa, 153.0 feet north 10 24t west and 330.2 feet epst of the west quarter corner of said Section '35; thence north 10 �4t west along said east line 507.980 feet; thence east 120.0 f eet; . thence north 36t east 180.0 feet; thence south 10 24t east 73.0 fest; thence south 420 i5t east 219,6 feet; thence south 300 18t east 77.2 feet to the north- west corner of Lot 9 of said Highland Park First Addition; thence south 340 48t west 255.7 feet to the northeast corner of lot 4 of said Highland Park First Addition; thence west 330.0 feet to the point of beginning, substantially as ' indicated upon the plat diagram attached hereto and by this reference made a part hereof, and more restrictively described as follows 1. Five feet along the boundary line of Lot 3 beginning at the southeast corner of said lot and extending northwesterly for a distance of &' feet more or less. The foregoing right is granted upon the express con- dition that the City of Ames will assume liability for all damage to the here inbefore described property caused by said c ity's failure to use due care in its exercise of the ranted right.
