RIGHT OF WAY PERMIT AND EASEMENT
We, Gunder Fjare and Jane Fjare, husband and wife, of
Story County, Iowa, in consideration of the sum of One Dollar
($1.00) , receipt of which is hereby acknowledged, do hereby grant
to the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, reconstruct,
maintain, and use its electric lines, consisting of poles, wires,
overhead or underground cables, fixtures, anchors, and other
similar equipment or any part thereof, for the sole purpose of
conveying electric current for power and lighting purposes,
together with the right to extend to any telephone , electric or
power company the right to use jointly with the grantee, any pole
placed pursuant to the provisions hereof, together with the right
to trim any trees where necessary to secure adequate clearance for
the safe operation of the electric lines, upon, underground, or
adjacent to that certain piece of real estate hereinafter describe
in the following manner:
Commencing at a point on the south line of the
Northwest quarter of Section 35s Township 84 north,
Range 24 west of the 5th P. M., Iowa, 1565.5 feet
east of the west quarter corner of said Section 35;
thence north 10 10t west 158.0 feet to the northeast
corner Lot 1, Gunder Fjare Second Subdivision, Ames,
Iowa; thence west 125.0 feet to the southeast corner
Lot 4 of said Gunder Fjare Second Subdivision; thence
north 10 101 west 472.0 feet to the northeast corner
Lot 10 of said Gunder Fjare Second Subdivision; thence
east 155.0 feet; thence south 10 101 east 630.0 feet
to the south line of said northwest quarter of
Section 35; thence west 30.0 feet to the point of
beginning
substantially as indicated upon the blueprint plan marked Exhibit
"A", attached hereto and by this reference made a part hereof, and
more restrictively described as:
The west 5 feet of Lots 1, 2, 3, 4, 5, 6 and 7.
The north 5 feet of Lot 5.
The south 5 feet of Lot s, 7 and 4.
The foregoing right is granted upon the express con-
dition that the City of Ames will assume liability for all damage
to the hereinbefore described property caused by said cityts
failure to use due care in its exercise of the granted right.
