RIGHT OF WAY PERMIT AND EASEMENT
We, Charles S. Jackson and Nina G. Jackson, husband and
wife, of Story County, Iowa, in consideration of the sum of One
Dollar ($1.00) , receipt of which is hereby acknowledged, do hereby
grant to the City of Ames, Iowa, a municipal corporation, its
successors and assigns, the perpetual right to constract, re-
construct, maintain, and use its electric lines, consisting of
poles, wires, overhead or underground cables, fixtures, anchors,
and other similar equipment or any part thereof, for the sole pur-
pose of conveying electric current for power and lighting purposes
together with the right to extend to any telephone, electric or
power company the right to use jointly with the grantee, any pole
placed pursuant to the provisions hereof, together with the right
to trim any trees where necessary to secure adequate clearance
for the same operation of the electric lines, upon, underground,
or adjacent to that certain piece of real estate hereinafter
described in the following manner :
Beginning at a point 471,43 feet south of the
center of the intersection of 32nd Avenue of
Scott Place Addition to Ames, Iowa with Ontario
Street (Said center of said intersection being
on the north line of Section 5, Township 83
North, Range 24 West, of the th P.M. Iowa) and
the starting point being 471.43 feet south
thereof at the center of said 32nd Avenue ;
thence west from said starting point parallel
with the north section line 257.38 feet;
thence south parallel with center line of 32nd
Avenue 191,57 feet; thence east to the center
line of s •said 32nd Avenue 257.38 feet, thence north
along the center line of said 32nd Avenue 191*57
feet to the place of beginning, said strip of
ground being located in the Northeast Fractional
Quarter (NE frl 4) of said Section 5, Township
83 North, Range 24 West, of the 5th P.M. Iowan
substantially as indicated upon the blueprint plan attached hereto
and made a part hereof, and more restrictively described as:
The north 5 feet of Lot 1,
The west 5 feet of Lots 1, 2 and 3,
The east 5 feet of Lot 4,
The north 10 feet of Lot 4,
all within Sunny Hill Subdivision to Ames, Iowa.
The foregoing right is granted upon the express conditiox
that the City of Ames will assume liability for all damage to the
hereinbefore described property caused by said city' s failure to
use due care in its exercise of the grapted right*
