RIGHT OF WAY PERMIT AND EASEMENT
We, John W. Moore and Opal I. Moore, husband and wife,
of Story County, Iowa, on consideration of the sum of One Dollar
($1.00) and other valuable consideration, receipt of which is
hereby acknowledged, do hereby grant to the City of Ames.. Iowa,
a municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain, and use its electric
lines, consisting of poles, wires, overhead or underground cables,
fixtures, anchors, and other similar equipment or any part thereof,
for the sole purpose of conveying electric current for power and
lighting purposes, together with the right to extend to any tele-
phone, electric or power company the right to use jointly with the
grantee, any pole placed pursuant to the provisions hereof,
together with the right to trim any trees where necessary to
secure adequate clearance for the safe operation of the electric
lines, upon, underground, or adjacent to that certain piece of
real estate hereinafter described in the following manner :
Commencing at the southwest corner lot 7,
Moore ' s Third Addition Country Club Heights,
Ames, Iowa; thence north 790 33t west 225.5
feet; thence northeasterly 10.6 feet along a
576.62 foot radius curve concave northwesterly;
thence north ?90 071 west 141.4 feet; thence
north 20 271 east 200.0 feet; thence north 00
361 west 40.0 feet to the southwest corner
lot 5, Moorets Second Addition Count yy Club
Heights; thence north 890 58t east 160.0 feet
to the southeast corner of said lot 5; thence
south 00 43t east 16.0 feet; thence north 890
561 east 180.1 feet; thence north 10 311 east
15.0 feet; thence east 70.5 feet; thence south
15.0 feet to the southeast corner of lot 22,
First Addition Country Club Heights; thence
south 110 47t west 308.2 feet to the point of
beginning.
substantially as indicated upon the blueprint plan attached hereto
nd made a part hereof, and more restrictively described as:
The east 5 feet of Lots 1, 2 and 3, and the
west 5 feet of Lots 4, 5 and 6.
The foregoing right is granted upon the express con-
dition that the City of Ames will assume liability for all
damage to the hereinbefore described property caused by said
city+ s failure to use due care in its exercise of the granted
right.
