Scholl, husband and wife, of Story County, Iowa, in consideration of the sum of One Dollar ($1.00) and other valuable consideration, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain, and use its electric lines, consisting of poles, wires, overhead or underground cables, fixtures, anchors, and other similar equipment or any part thereof, for the sole purpose of conveying electric current for power and lighting purposes, together with the right to extend to any tele- phone, electric or power company the right to use jointly with the grantee, any pole placed pursuant to the provisions hereof, together with the right to trim any trees where necessary to secure adequate clearance for the safe operation of the electric lines, upon, underground, or adjacent to that certain piece of real estate hereinafter described in the following manner : Commencing at a point 941.1 feet east of the north quarter corner of Section 5, Township 83 north, range 24 west of the 5th P. M., Iowa, thence east 222.0 feet along the north line of the northeast fractional quarter of said Section 5; thence south 445.1 feet to the northeast corner of lot 4, Scholl' s First Subdivision, Ames, Iowa; thence west 222.0-feet to the northeast corner of lot of said Schollts First Subdivision; 45.5 thence north feet to the point of beginning, Ames, Iax a, substantially as indicated upon the blueprint plan attached hereto and made a part hereof, and more restrictively described as : The south 5 reet of lots 2 and 5; the north 5 feet of lot 3 and the north 5 g.edt'of 16 � of Scholl,'s First`Sub4it�s_l n; Ame s', . The �oregofng right is granted upon the express con- dition that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said cityt failure to use due care in its exercise of the granted right.
