Scholl, husband and wife of Story County, Iowa , in consideration of the sum of One Dollar ($1.00) and other valuable consideration, receipt of which is here- by acknowledged, do hereby grant to the City of .Ames, Iowa , a municipal corporation, its successors and assigns , the perpetual right to construct, reconstruct , maintain, and use its electric lines , consisting of poles , wires, overhead or underground cables , • fixtures , anchors , and other similar equipment or any part thereof for the sole purpose of conveying electric current for power and lighting purposes , together with the right to extend to any tele- phone, electric or power company the right to use jointly with the grantee, any pole placed pursuant to the provisions hereof , together with. the right to trim any trees where necessary to secure adequate clearance for the safe operation of the electric lines , upon, underground, or adjacent to that certain piece of real estate here- inafter described in the following manner: Commencing at a point 634.7 Feet East and 620.0 Feet South of the North Quarter Corner of Section 5, Township 83 North, Range 24 West of the 5th P. M. , Iowa, thence East 156.4 Feet, thence North 175.0 Feet , thence East 372.0 Feet, thence South 380.0 Feet to the Center line of Ross Road, thence West 528.4 Feet along said Center line, thence North 205.0 Feet to the point of beginning, .Ames , Iowa, substantially as indicated upon the blueprint plan attacked hereto and made a part hereof, and more restrictively described as: The East 5 Feet of Lots 1 , 3 and 4, The North 5 Feet of Lots 1 and 2, The South 5 Feet of Lots 3 and 6, The West 5 Feet pf Lots 5 and 6 , The North 10 Feet of Lots 79 8 and 9. The foregoing right is granted upon the express conditio that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said cityts failure to use due care in its exercise of the granted right. 0 A GE 9 Witness our hands this �Lday of 1955.
