Hugh Kelley and Ethel Kelley, husband and wife , in consideration of the sum of One Dollar ($1.00) and Other Valuable Consideration, receipt of which is hereby acknowledged, do hereby grant to the City of Ames , Iowa , a municipal corporation, its successors and assigns , the perpetual right to construct , reconstruct, maintain, and use its electric fixtures , anchors and other similar equipment or any part thereof for the sole purpose of conveying electric current for power and lighting purposes , together with a right to extend to any telephone , electric or power company the right to use jointly with the grantee any pole placed pursuant to the provisions hereof , together with the right to trim any trees where necessary to secure adequate clearance for the safe opera- tion of the electric lines , upon, underground , or adjacent to that certain piece of real estate described in the following manner : The subdivision of the Southeast Quarter of the Southeast Quarter , except the North 240 Feet of the East 363 Feet , and except the East 264 Feet of the South 412.5 Feet , and the East 10 Acres of the Southwest Quarter of the Southeast Quarter of Section 6 , Township 83 North, Range 24 West of the 5th P. M. , Story County, Iowa, and specifically described by lots therein as follows: The North 5 Feet of Lots 4, 5, 61 71 81 9 and 10, and the South 5 Feet of Lots 11 , 12 , and 13. The foregoing right is granted upon the express condition that the City of Ames shall assume liability for all damage to the hereinbefore described property caused by said city' s failure to use due care in its exercise of the granted right.
